Pear Digital Marketing Limited (Trading as Lead Pears)
1. Introduction
Welcome to Lead Pears, operated by Pear Digital Marketing Limited ("we," "us," "our"). These Terms and Conditions govern your use of our digital marketing services. By engaging our services, you agree to abide by these terms. If you do not agree, please do not proceed with our services.
2. Services Provided
Lead Pears provides digital marketing services, including but not limited to PPC management, lead generation via paid ads and social media marketing. We make no guarantees regarding specific outcomes or results from our services.
3. No Guarantee of Results
While we strive to provide high-quality services, we do not guarantee any specific results, rankings, traffic, sales, or other performance metrics. The effectiveness of digital marketing strategies can vary due to numerous factors beyond our control.
4. No Refund Policy
All payments made for our services are non-refundable. By engaging with our services, you acknowledge and accept that refunds will not be provided under any circumstances.
5. Queries and Customer Support
Clients can raise any questions or concerns via email at hello@leadpears.com. We will endeavour to respond within 24 hours during regular business days.
6. Contract Duration and Termination
Our services require an initial commitment of 90 days. After this period, there is no fixed contract, and clients may continue using our services on a rolling basis. Clients may terminate their service at any time by providing 30 days' written notice via email.
7. Payment Terms
Payments for our services must be made as per the agreed payment schedule. Failure to make timely payments may result in service suspension or termination.
8. Limitation of Liability
To the maximum extent permitted by UK law, Pear Digital Marketing Limited shall not be liable for any indirect, incidental, or consequential losses arising from the use of our services. Our total liability under any contract for services shall not exceed the total fees paid by the client for the services in question.
9. Data Protection and Confidentiality
We comply with UK GDPR and Data Protection laws in handling client data. Both parties agree to keep any confidential information private and not disclose it to third parties unless required by law.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Amendments
We reserve the right to update or amend these Terms and Conditions at any time. Clients will be notified of any significant changes via email or our website. 12. Our Fees and charges.
We charge for our management fee £599+VAT per month. Additional charges are as follows.
* The client will be given £10 of free SMS credit when you sign up and this will be added to the clients account every month, £10 gives you 422 SMS messages at a 160 character limit (1 SMS is 160 characters). Additional SMS's will be billed at £0.0237 per SMS.
Any unused SMS's will be rolled over into the clients account in the next billing cycle. The client will also be billed £1-£2 per month for the mobile phone number associated with the clients chat bot.
During any free trial period the client will still be responsible for the ad spend payable directly to META and/or Google, and the chat bot phone number and SMS costs. The management fee will commence after the 21 day period.
